This writ of error is prosecuted to reverse a judgment of the Circuit Court, for the district of Ohio, rendered in favour of the defendants, in an action of ejectment instituted by the plaintiff in error against the defendants, in the Court below, to recover a tract of land in Perry county, On the trial of the general issue, which was joined between the parties, the plaintiff gave in evidence a patent from the President of the United States to Jesse Spencer, dated the 15th of November 1811, for the land in controversy: a deed of conveyance for the land, from Jesse Spencer to William Steele, purporting to bear date the 20th of January 1818; and also a deed from William Steele to Robert Steele, dated the 7th of July 1821, prior to the institution of the suit. It appeared, from a certificate on the deed from Jesse Spencer to William Steele, that it had been acknowledged, on the day of its date, before a justice of the peace; and it was attested by two subscribing witnesses.
